Welcome to Slapjoy. The terms "Slapjoy", "we", "us" and "our" refer to Slapjoy, which operates the website www.slapjoy.com and all related information, content, features, tools, products and services (the "Services"). Slapjoy is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with our Privacy Policy, Shipping Policy and Refund Policy (together, the "Terms"), describe your rights and responsibilities when you use the Services. By visiting, browsing or purchasing from the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Access and accounts

By using the Services, you confirm that you are at least the age of majority in your state of residence, or that you have that person's consent. You agree that the information you give us, including your email, billing and shipping details, is accurate, current and complete.

If you create an account, you are responsible for keeping your login details secure and for all activity under your account. You may not transfer or sell your account to anyone else.

2. Our products

We try to show our products, colors and details as accurately as possible. Colors and appearance may look slightly different on your screen depending on your device and settings.

Some products are made or shipped by our trusted partner brands and makers. Product descriptions, availability and prices may change at any time without notice. We may limit quantities or discontinue a product at our discretion.

3. Personalized items

When you order a personalized item, you are responsible for the names, text, dates, photos and other details you provide. Please check spelling and your preview carefully before placing your order, because personalized items are made to your instructions.

You confirm that you own or have permission to use any content you upload, and that it does not infringe anyone else's rights or contain unlawful, hateful, obscene or offensive material. We may refuse or cancel any personalized order that does not meet these standards, and refund you in full.

4. Orders and pricing

Placing an order is an offer to buy. Your order is accepted only when we confirm it, and we may decline or cancel any order for any reason, including suspected fraud, an error in price or description, or a product being unavailable. If we cancel an order after you have paid, we will refund you in full.

All prices are in U.S. dollars. Prices, promotions and discount codes may change or end at any time, and discount codes cannot be combined unless stated.

5. Payment

You agree to pay all charges for your order, including applicable taxes and shipping, using a valid payment method. Payments are processed securely by Shopify and its payment partners. We do not store your full card details.

6. Shipping, returns and refunds

We currently ship within the United States only. Delivery times, costs and how we handle lost or damaged packages are described in our Shipping Policy. Returns, replacements, cancellations and refunds are handled according to our Refund Policy. Risk of loss passes to you when your order is delivered to the carrier, except as our policies say otherwise.

7. Reviews and content you share

If you send us reviews, photos, comments or ideas, you give Slapjoy a non-exclusive, royalty-free, worldwide license to use, display and share that content in connection with the Services and our marketing. You are responsible for what you submit, and it must not be false, unlawful, defamatory or infringe anyone's rights. We may remove any content at our discretion.

8. Prohibited uses

You may not use the Services to break any law; infringe anyone's intellectual property; harass or harm others; submit false information; place fraudulent orders; upload viruses or malicious code; scrape or collect data from the site; or interfere with the security or operation of the Services. We may suspend or end your access if you break these Terms.

The Slapjoy name, logo, website design, text, graphics, photos and other content are owned by Slapjoy or its licensors and are protected by law. You may not copy, reproduce or use them for commercial purposes without our written permission. Your purchases are for personal use and not for resale.

The Services may include links to third-party websites or products made by partner brands. We are not responsible for third-party websites, their content or their privacy practices. Please review their terms before using them.

11. Disclaimers

The Services and all products are provided "as is" and "as available", except as expressly stated in our policies or as required by law. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, secure or error-free.

12. Limitation of liability

To the fullest extent permitted by law, Slapjoy and its owners, staff, partners and service providers are not liable for any indirect, incidental, special or consequential damages arising from your use of the Services or any product. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Some states do not allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to defend and hold harmless Slapjoy and its owners, staff and partners from any claims, losses or costs, including reasonable legal fees, arising from your breach of these Terms, your violation of any law, or content you provide, including personalization details.

14. Governing law

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Texas, unless the law requires otherwise.

15. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the date below will be updated. Continuing to use the Services after changes are posted means you accept the updated Terms.
